1. Agreement to Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website located at homeschoolherbalacademy.com, along with all associated courses, curriculum, digital materials, memberships, and services (collectively, the “Services”). The Services are owned and operated by Root and Leaf, LLC, doing business as Homeschool Herbal Academy (“Homeschool Herbal Academy,” “we,” “us,” or “our”).
By accessing the website, creating an account, purchasing a course, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree to these Terms, you may not access or use the Services.
We may revise these Terms at any time. Revised Terms take effect when posted to this page, and the “Last Updated” date will reflect the change. Your continued use of the Services after revised Terms are posted constitutes your acceptance of them. We encourage you to review this page periodically.

3. Educational Purpose Only — Not Medical Advice
Please read this section carefully.
Homeschool Herbal Academy provides educational content about herbalism, botany, plant identification, and traditional plant use. All content offered through the Services — including courses, videos, written lessons, downloadable materials, recipes, formulations, plant monographs, and communications from instructors — is provided for general educational and informational purposes only.
Our content is not medical advice, diagnosis, or treatment, and it is not a substitute for consultation with a qualified healthcare provider. We are not physicians, and nothing in the Services establishes a practitioner-patient relationship between you and Homeschool Herbal Academy or any of its instructors, contributors, or affiliates.
Statements made about herbs, plants, or preparations have not been evaluated by the U.S. Food and Drug Administration. No content offered through the Services is intended to diagnose, treat, cure, or prevent any disease.
You should always consult a qualified healthcare provider before:
- Using any herb or plant preparation, whether internally or topically
- Making changes to your diet, supplement regimen, or health routine
- Using any herb in combination with prescription or over-the-counter medication
- Using any herb during pregnancy or while nursing
- Administering any herb or preparation to a child, infant, or elderly person
- Using any herb if you have a known medical condition or allergy
Plant identification carries serious risk. Many plants have toxic or deadly look-alikes. Photographs, illustrations, and written descriptions provided through the Services are educational aids only and are not sufficient for safely identifying plants for consumption or topical use. Never ingest or apply any wild plant based solely on information from our Services. Always confirm identification with a qualified expert in your region.
You assume full responsibility for any decision you make, or that you permit a minor in your care to make, based on information obtained through the Services.
4. Eligibility and Use by Minors
The Services are intended for use by adults aged 18 and older.
Minors may access and use the Services only under the direct supervision of a parent or legal guardian. This is a homeschool curriculum, and we anticipate that students under 18 will engage with our materials. That engagement must be supervised.
If you are a parent or legal guardian permitting a minor to use the Services, you agree that:
- You have read, understood, and accepted these Terms on the minor’s behalf and on your own behalf;
- You are solely responsible for supervising the minor’s access to and use of the Services;
- You are solely responsible for the minor’s safety in connection with any hands-on activity, plant handling, foraging, preparation, or application described in our materials;
- You accept full responsibility for all activity that occurs under your account, including activity by the minor;
- You will not permit a minor to independently gather, prepare, ingest, or apply any plant or plant preparation without your direct supervision.
Accounts must be registered and held by an adult. Minors may not create accounts, submit payment information, or enter into transactions with us. All purchases must be made by a parent or legal guardian aged 18 or older.
We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided personal information to us directly, please contact info@homeschoolherbalacademy.com so we can remove it. Please see our Privacy Policy for more detail.
5. Accounts
To access certain Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at info@homeschoolherbalacademy.com if you suspect unauthorized use of your account.
Accounts are for individual family or household use only. You may not share account credentials with, sell access to, or transfer your account to persons outside your immediate household. Co-op, classroom, group, and institutional use requires a separate license — contact us for details.
We reserve the right to suspend or terminate any account that we reasonably believe is being shared, resold, or otherwise used in violation of these Terms.
6. Purchases and Payment
Prices for courses, memberships, and materials are listed on the website and are stated in U.S. dollars. Prices are subject to change, but changes will not affect purchases already completed.
By providing payment information, you represent that you are authorized to use the payment method and that the information you provide is accurate. Payment processing is handled by third-party processors, and your use of those services is subject to their terms.
Applicable sales tax will be added where required by law.
If a recurring subscription or payment plan is offered and you enroll in one, you authorize us to charge your payment method on the stated recurring schedule until you cancel. Cancellation instructions will be provided at the time of purchase and within your account. Cancellation stops future charges; it does not automatically trigger a refund of charges already made, except as provided in Section 7.
7. 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee on purchases made directly through our website.
If you are not satisfied with your purchase, you may request a full refund within 30 days of the date of purchase by emailing info@homeschoolherbalacademy.com with your name, the email address associated with your account, and the purchase in question.
Terms of the guarantee:
- Refund requests must be received within 30 days of the original purchase date. Requests received after that window will not be eligible.
- Approved refunds are issued to the original payment method. Please allow 5–10 business days for the refund to appear, depending on your financial institution.
- Upon issuance of a refund, your access to the associated course, membership, or materials will be revoked, and any license granted to you under Section 8 terminates immediately. You must cease use of and delete any downloaded materials associated with the refunded purchase.
- The guarantee applies to purchases made directly through our website. Purchases made through third-party retailers, resellers, or platforms are governed by that seller’s refund policy.
- The guarantee is limited to one refund per customer per product. We reserve the right to deny refund requests where we reasonably determine the guarantee is being abused, including repeated purchase-and-refund patterns or bulk downloading of materials followed by a refund request.
- Physical goods, if any, may be subject to additional return requirements that will be stated at the time of purchase.
8. License to Use Our Content
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our courses and materials for your own personal, non-commercial, single-household homeschool use.
You may:
- View, stream, and access course content for your household’s educational use
- Download and print materials expressly designated as downloadable or printable, for use within your household
- Make copies of printable worksheets and student materials as needed for the children in your own household
You may not:
- Copy, reproduce, distribute, republish, display, sell, rent, sublicense, or transmit any portion of our content outside your household
- Share your account credentials or provide access to non-household members
- Use our content in a co-op, classroom, tutoring practice, school, or other group setting without a separate license from us
- Create derivative works based on our content, or incorporate our content into your own curriculum, products, or offerings
- Remove, obscure, or alter any copyright, trademark, or proprietary notice
- Record, screen-capture, or re-host video or live session content
- Use automated tools to scrape, crawl, download, or harvest content from the Services
- Use our content or any portion of it to train, fine-tune, or develop any machine learning or artificial intelligence model
All content, curriculum, text, graphics, photographs, illustrations, video, audio, logos, and the compilation and arrangement thereof are the property of Root and Leaf, LLC or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
“Homeschool Herbal Academy” and our logos are trademarks of Root and Leaf, LLC. You may not use them without our prior written permission.
9. User Content
If the Services allow you to submit content — including forum posts, comments, questions, photographs, project submissions, or reviews (“User Content”) — you retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, and display that User Content in connection with operating and promoting the Services.
You represent that you own or have the necessary rights to your User Content and that it does not infringe the rights of any third party.
You agree not to submit User Content that:
- Is unlawful, harassing, abusive, threatening, defamatory, obscene, or hateful
- Infringes any patent, trademark, copyright, or other proprietary right
- Contains software viruses or malicious code
- Constitutes unsolicited advertising, spam, or commercial solicitation
- Offers medical advice, diagnosis, dosing recommendations, or treatment protocols to other users
- Reveals personal information about a minor, including a minor’s full name, address, school, or location
- Impersonates any person or entity
We do not pre-screen User Content but reserve the right, without obligation, to remove any User Content at our sole discretion and to suspend or terminate accounts that violate these standards.
Parental note: if you permit a minor to participate in any interactive feature, you are responsible for supervising that participation.
10. Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Attempt to gain unauthorized access to the Services, other users’ accounts, or our systems or networks
- Interfere with, disrupt, or impose an unreasonable load on the Services or supporting infrastructure
- Circumvent, disable, or interfere with security-related features or access restrictions
- Misrepresent your identity or affiliation with any person or entity
- Use the Services to sell, promote, or advertise competing products or services
11. Third-Party Links and Materials
The Services may contain links to third-party websites, products, suppliers, or resources, including herb suppliers, book recommendations, and outside educational materials. These links are provided for convenience only. We do not control, endorse, or assume responsibility for third-party content, products, or practices. Your dealings with third parties are solely between you and that third party.
Some links may be affiliate links, meaning we may earn a commission if you make a purchase. This does not affect the price you pay. We disclose affiliate relationships where required by law.
12. Assumption of Risk
Herbalism is a hands-on practice. Activities described in our materials may involve foraging, handling plants, working with heat, using tools, and preparing substances for topical or internal use. These activities carry inherent risks, including allergic reaction, poisoning, injury, burns, skin irritation, and, in the case of misidentification or misuse, serious illness or death.
By using the Services, you voluntarily assume all risks associated with your use of our content and with any activity you or a minor in your care undertakes based on it. You are responsible for evaluating whether any activity is appropriate for the age, maturity, health status, and allergy profile of any student in your household, and for providing appropriate supervision and safety measures.
13. Disclaimer of Warranties
THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, ROOT AND LEAF, LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, secure, timely, or error-free; that defects will be corrected; that content is accurate, complete, reliable, or current; or that the Services will produce any particular educational outcome.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROOT AND LEAF, LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, INSTRUCTORS, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM PERSONAL INJURY, ILLNESS, ALLERGIC REACTION, ADVERSE REACTION, POISONING, OR PROPERTY DAMAGE RESULTING FROM THE USE, PREPARATION, IDENTIFICATION, OR APPLICATION OF ANY PLANT OR PLANT PREPARATION DESCRIBED IN OUR CONTENT.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
15. Indemnification
You agree to indemnify, defend, and hold harmless Root and Leaf, LLC and its members, managers, officers, employees, instructors, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; (d) your User Content; or (e) any activity undertaken by you or by a minor under your supervision based on our content.
16. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice, including for violation of these Terms.
You may stop using the Services at any time and may cancel your account by contacting info@homeschoolherbalacademy.com.
Upon termination, your license under Section 8 ends immediately and you must cease use of and delete all downloaded materials. Sections 3, 8, 9, 12, 13, 14, 15, 17, and 18 survive termination.
Termination by us for cause does not entitle you to a refund except as required by law or as provided under Section 7.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict of law provisions.
You agree that any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.
Informal resolution first. Before filing any claim, you agree to contact us at info@homeschoolherbalacademy.com and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
18. General Provisions
Entire Agreement. These Terms, together with our Privacy Policy and any additional terms applicable to specific Services, constitute the entire agreement between you and us regarding the Services.
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control.
Headings. Section headings are for convenience only and do not affect interpretation.
